FMT,
I am not saying that the mechanic is legally bound to ask, but he is legally bound to sell the appropriate service (suitable for the purpose). A missing stamp means that there is no evidence that the previous servicing was done. Therefore, it is in the interests of the mechanic to include the corresponding clause into the contract (order, invoice, etc.). Otherwise, there is a risk that the servicing may be not suitable for the purpose, which means full refund plus possible damages.

A missing stamp means absolutely nothing, many people forget to take their service book along or simply cannot be bothered or whatever, you are living in cloud cuckoo land if you really think your argument would stand up in front of a SCC. It is in the interests of the mechanic to do so but they are not legally bound to do so. He is legally bound to provide a service for which he is asked to carry out irrelevant of what the service book may say. As previously mentioned a 'service' is an arbitrary term. The OP is still not forthcoming in the information department!

So would k4j 740 be a straight swap as well? Its also a megane 1.4 engine as well.

I do have the receipts from the garage and i'll contact them asap, most garages down east london are closed till after new years.

Finally got the car fixed, got it back from the garage on monday evening. Total cost of the repair was £900 that includes a 2006 engine (12k on clock), new timing belt kit, new water pump, new clutch kit (might aswell since the engine's out), oils etc. the engine swap weren't as easy as first thought my car is 54 reg and the replacement engine was from a 06 reg so some parts were mounted differently so the mechanics had to rearrange it. no problems with the ecu and the electrics, car starts fine and drives really well. the mechanics told me to go back to them in 2 weeks just to check everything okay and to change the oil again as the engine might of been sitting around for a while. i orders some bosch super 4 spark plugs so i'm gonna change it when it arrives. thanks for the people that replied to my post and given some advise.

That is £900 well spent. Congratulations!

Best advice for Megane owners: sell it before it bankrupts you!
