Pot hole

Postby wanda » Fri Feb 05, 2010 6:28 pm

Went over a pot hole so deep that one of the alloys buckled :banghead :mad . Got picture of the pot hole (more like cave) and am going to claim of the council . Has anyone got any experience with this?

Is there anything I should watch out for? I take it I will have to fight for a couple of months before I get anything.

Never claimed myself, but inform police who will alse inform council, that way it backs up your claim. When you ring get reference number from police and submit that also get car checked over and claim for tracking.

I've read about a few of these issues in Honest Johns' column in the paper. He usually recommends contacting the council about your problem, then put what you want doing in writing to the person concerned.

It usually ends with you paying for it initially and then claiming off the council through the small claims court if they refuse to cough up. If you have the proper evidence though you shouldn't have a problem.

I'm sure I've heard this somewhere before.. but you have a higher chance of claim being successful if the pothole has previously been reported to the council - therefore the council knew it was there, but haven't done anything about it. Use the Freedom of Information Act to find out this information.

The general consensus on this is that often the council will not pay out (particularly with speed bumps), however, if you have photographs (featuring a ruler showing depth and size) then you might have some luck.

Best advice for Megane owners: sell it before it bankrupts you!

well if you have a 16 inch alloy that can fit 195/50 extra load tyres then I might be tempted.

a few years ago i bent a 17" wheel in a crater of a pot hole, complained to the council, their policy was that they will only pay out to the first two people to complain guess what i was the third person bollocks.threatened them with legal action and they weren't interested so i was out of pocket to the tune of £250 for new tyre&rim
